宜宾市华卉商贸有限责任公司（以下简称华卉公司）的实际负责人韩波的公司承包了一项劳务开采业务，该业务是由政府和国企主导的采砂项目。然而，韩波的公司被指控超量、超时限开采长江砂石，将因此被追究刑事责任。韩波的公司按照合同要求进行作业，此前并不知情超采一事。他从国企承包的开采业务得到了许可授权，并在相关执法部门的监管下采砂。然而，现在被公安部门立案调查并被批准逮捕，而上游发包给他们相关国企却安然无恙。 南溪区人民检察院指控韩波等人在河道采矿许可证超期的情况下，超量、超期限开采长江砂石，其破坏性开采行为导致河滩地被江水侵蚀冲毁，对生态系统造成不可逆的破坏，应以非法采矿罪追究刑责。此外，砂石项目层层转包，开采限制逐渐放开，韩波的公司按照合同采砂，但最终却承担了责任。 韩波表示，他们按照合同要求投入巨大，但最终却面临无法收回成本的风险。而且，尽管行政处罚认定上游企业违法，但罚没的却是他们开采的砂石，造成了他们的巨大损失。对此，他们曾提起行政复议，但因不具备复议申请人资格未被受理。 南溪区水利局一位知情人士证实，确实存在超采的情况，但超采的责任并不仅仅在韩波的公司。因为当年长江要保护珍稀鱼类，所以决定统一规范开采并探索新模式。南溪区兴南公司通过竞拍取得了砂石开采权后，因资金短缺无法支付劳务费，于是允许韩波的公司自行销售开采的砂石。同时南溪区政府也成立了协调处理小组来解决相关问题。然而最终韩波的公司承担了责任并被立案调查。目前案件尚未开庭，仍在处理中。
