The Supreme People’s Procuratorate: The exploration and establishment of the public interest litigation system by the procuratorial organs has seen steady growth in case handling over the past ten years.
On December 5th, the Supreme People’s Procuratorate held a press conference where Xu Xiangchun, the Director of the Public Interest Litigation Office, introduced that over the past decade since the establishment of the public interest litigation system, the scale of cases has steadily increased. From the full implementation of the public interest litigation system in July 2017 to October this year, a total of 1.093 million public interest litigation cases have been handled nationwide, including 982,000 administrative public interest litigation cases and 111,000 civil public interest litigation cases.
Xu Xiangchun stated that over the past ten years, the procuratorial authorities have consistently adhered to the correct case-handling philosophy. They have prioritized urging administrative agencies to perform their duties in accordance with the law before litigation, aiming for the best case-handling results with higher efficiency and lower costs. “We have issued 784,000 procuratorial suggestions to administrative agencies, with the vast majority correcting their mistakes, resulting in a rectification response rate of 98.7%. For cases that have not been rectified by the deadline, we insist on reflecting judicial value through litigation confirmation. We have filed 6,063 administrative public interest litigation cases in court, with 99.3% receiving judicial support.”
Xu Xiangchun pointed out that the next step will be to take the opportunity of public interest litigation legislation to actively promote the basic value pursuit of “handling every case with high quality and efficiency” in the field of public interest litigation. This will be specified and practiced through integrated management of the “three managements,” exploring new business management models to enhance high-quality case handling through high-level management, and promoting the development of public interest litigation prosecution to a higher quality at a new starting point.
