A band stylist apologized after buying a jacket online for a performance but returning it afterwards as “no reason return”. How should the involved brand safeguard its rights?
On January 7th, the clothing brand “JUNBYYANGJUN” announced that the Wutiaoren band had purchased two suits online from their flagship store to wear at a New Year’s Eve performance on a certain TV station. After dancing vigorously and sweating profusely, they applied for a return and refund.
According to the post, the band initially tried to communicate with the store about borrowing the clothes, but was rejected because they did not match the brand’s style. Subsequently, they purchased the two suits online.
Some netizens have shared photos of the two band members performing and the two pieces of clothing they wore, including a women’s coat and a women’s suit.
Regarding this event, on the evening of January 7th, the band’s stylist @BEEPINK_STUDIO issued an apology on microblog stating: “I, AU, as a stylist from beepink studio, purchased the JUNBYYANGJUN brand @JUNBYYANGJUN jackets through Tmall for the artist @五条人WUTIAOREN to wear at a TV station’s New Year’s Eve performance. I was lucky enough to successfully return the products and receive a refund after the performance.”
@BEEPINK_STUDIO expressed that they have recognized that their actions have seriously affected the brand and artist’s image. They sincerely apologized to JUNBYYANGJUN brand and have begun to make related compensation to minimize the impact.
@BEEPINK_STUDIO also mentioned that the artist was unjustly involved in this incident and has caused a negative impact. They apologized for this and stated that they have contacted the brand to purchase the returned products that were already used and have maintained subsequent communication with the brand.
It is understood that “JUNBYYANGJUN” has deleted the original post.
According to previous reports by “Zhengzai News”, Wutiaoren’s agent responded to the incident saying that the team’s agency was previously unaware of this matter, and that the stylist has already communicated and publicly apologized.
On January 8th, The Paper reported that they had contacted Shanghai Junyang Clothing Co., Ltd., the company associated with “JUNBYYANGJUN” brand, multiple times but did not receive a valid response.
Public information shows that Shanghai Junyang Clothing Co., Ltd. was established on October 29th, 2021 with a registered capital of 1 million yuan.
The Paper noticed that the photos taken at Wutiaoren’s performance on “JUNBYYANGJUN” official store show the clothing worn by them with prices of 2926 yuan and 3459 yuan respectively. Both items are shown as accepting “7-day no reason return”.
For issues such as how “JUNBYYANGJUN” will safeguard their rights in the future, on January 8th, a representative from the brand store responded saying they were “not clear for now”.
Xing Xin, a senior partner and lawyer at Hunan Jinzhou Law Firm, analyzed this incident stating that due to reasons such as heavy exercise, the clothing has inevitably been stained with sweat and no longer meets the return standards. The stylist’s actions have directly caused losses to the merchant and affected the artist’s reputation as well. As for how “JUNBYYANGJUN” can safeguard their rights in the future, Xing Xin suggested that the online shopping platform is a direct way to do so. “JUNBYYANGJUN” can try to appeal to Taobao and request platform intervention. “The stylist has expressed willingness to compensate, so JUNBYYANGJUN can try to negotiate with them and reach a consensus on losses.” Xing Xin also reminded that no matter which way of safeguarding rights they choose, “JUNBYYANGJUN” needs to prepare and preserve evidence.
